to a neighboring State, enjoying the fruits of all his own possessions. If he has done damage to the wounded man, he shall pay for it in full to him that is damaged; and the damage shall be assessed by the court which decides the case, which court shall consist of those who would have tried the culprit for murder if the man had died of the wound he received.
